Under the FTC Funeral Rule, funeral directors must: Disclose in writing that, except in certain circumstances, embalming is not required by law. They may not suggest that embalming is required by law when it is not. Obtain permission from the family before embalming unless embalming is required by state law. A fee may not be charged for an unauthorized embalming. Disclose in writing that you usually have the right to choose a disposition such as direct cremation or immediate burial if you do not want embalming. Disclose in writing that certain funeral arrangements, such as a funeral with viewing, may make embalming a practical necessity and, thus, a required purchase.
